Oklahoma City, OK, United States (AHN) – An Oklahoma teacher last Friday arrested a student for being in possession of a permanent marker.
Apparently the 13-year-old Roosevelt Middle School student violated a little known city ordinance which prohibits the possession of a permanent marker in certain circumstances.
The boy was caught using a permanent marker at Roosevelt Middle School by a teacher, according to the crime report filed with the Oklahoma City Police Department.
Delynn Woodside, 50, a math teacher at the school noticed the marker bled through a piece of paper and made a citizen’s arrest. Police were then notified and transferred the student to a juvenile detention center.
Reportedly before the boy was detained he tried to hide the marker from the teacher when she asked for it.
A school district spokeswoman said officials will review the incident upon students return from winter break, which began Friday.
Allegedly the boy violated City Ordinance 35-202, which states it is illegal for any person to possess spray paint or a permanent marker on private property without the permission of the property owner.
“No person may possess an aerosol spray paint container or broad-tipped indelible marker on any private property unless the owner, agent, manager, or other person having control of the property consented to the presence of the aerosol spray paint container or broad-tipped indelible marker,” the ordinance reads.
The law was originally targeted at curbing graffiti and is listed under the nuisance chapter of city ordinance.
